Control Of Asbestos
at Work Act. Reg. 4 2006 (The duty
to manage).
Applies to :- Non domestic properties and includes the common
parts of residential blocks of flats.
Who is the duty holder
Every person who has, by virtue of a
contract or tenancy, an obligation of any extent in relation to the
maintenance or repair of non-domestic premises or any means of access
thereto or egress there from; or In relation to
any part of non-domestic premises where there is no such contract or tenancy,
every person who has, to any extent, control of that part of the
non-domestic premises or any means of access thereto or egress there from.
Once the duty holder has been
identified, they will have to: -
1.
Find out if there is asbestos, how much, its condition and where.
2.
Presume unknown materials are Asbestos containing materials.
3.
Make and keep an up-to-date record of the location and condition of
Asbestos Containing Materials and/or presumed Asbestos containing
materials.
4.
Assess the risks from Asbestos containing materials.
5.
Prepare a written management plan.
6.
Implement the plan.
7.
Monitor and review the plan.
8. Provide information on the location and
condition of the Asbestos containing materials.
